The rules seem clear to me --they don't take a waver test when
prompted to retire because when prompted they are not in charge
reach. What happens later happens later.

According to my example, they were in charge reach when prompted to retire....
I just wanted to make that clear in case some wires are getting crossed here.

Illegal targets are by definition out of charge reach. the rule, again, is:
"If the body cannot legally declare a charge against a target or is prevented
from doing so by some obstacle such as terrain or an intervening body, that
target is not in the body's charge reach."
I have been made to quote this rule (6.162) on this issue three times now.
Please go to page 38 and read it...lol
There is no 'pause' in the middle of a tactical move to see if a body's status
has changed. When the HC is prompted to retire, it is not in charge reach of
the LI (the LI cannot legally charge the HC). The waver, by the way, isn't even
for the move in the first place - it is for the prompt. You never have to take
a waver for an umprompted retirement...
