Yes and yes.

I'm still working with my Patrician Roman list (nope, haven't given up
yet), and realized that my new list might not be legal.
The list says:
"Extra to upgrade Reg C Legionaries/Auxilia to Reg B @ 4 pts if
MI/LMI, @ 2 pts if LI ..... 0-1/2"
The standard Legionary, Auxilia, Skirmisher, comes straight of the box
as morale grade D, and first must be upgraded to C. My question is,
does the 0-1/2 requirement apply to only the elements that have been
upgraded to C, or does it apply to all the elements regardless whether
they are C or D?
In my new list I have:
12 elements of Reg B LMI Auxilia
6 elements of Reg C MI Legionaries
6 elements of Reg D LMI Auxilia Bowmen
8 elements of Reg D LI Legionary Skirmishers
6 elements of Reg C LI Legionary Skirmishers
That's a total of 38 elements, with 12 upgraded to Reg B, which is
less than 1/2 of the total. If I don't count the D's, than it's 24
total elements with 12 upgraded to B - okay?
I'm just not sure that I'm doing this correctly and wanted to check.
Thanks for the help.

Please don't take this as a snarky question, I mean it honestly.
This is an army that's not even a shadow of it's former self, where
you could buy Aetius' army comprised of the elite of Roman troops
with massed barbarians ... leaving the poorer Roman troops and
legions as frontier guards.
Now, I don't expect any change ... but am curious why the victor at
Chalon was given such rough treatment. Again, not meant to be overly
critical ... just curious.

Greg:
Although I would love to see the Patricians more powerful, I can't
really disagree with the historical approach to the list. Most of the
"Roman" troops probably weren't that high grade in 451 AD. Aetius, in
order to win at Chalons, was forced to recruit masses of barbarian
federates - Alans, Visigoths, Franks, and Burgundians. The relatively
small number of Roman troops he had were defensively placed on the
battlefield's sole hill, where Attila supposedly instructed his army
to ignore them in order to attack the Alans and Visigoths instead.
And, if you think your Pats are now worthless, (obviously I don't
agree with that assessment), couldn't you make use of the figures by
shifting them over to a LIR army?

I don't see a question mark.
As for rough treatment, I'd have to know what the issue is. Please let me know.
All I ask is that you don't do it in terms of the differences between 7th lists
and Warrior lists.

I agree, but more battles were fought than the one at Chalon.

I actually did this once offline Jon ... which I'm sure you already
know. I sent you about a three page email, complete with sources and
logic for the inevitable assumtions.
You gave me a three word answer ... "we don't agree."
Just never mind ... like I said, I don't want to start a fight, I'm
just curious why this army is considerably weaker than it was before.
I honestly thought FHE was going to try to avoid that.

I do remember. I assumed that you had some new info you wanted to share.
FHE is going to avoid changing Warrior lists so that players can have confidence
that if they buy a Warrior army it will never 'get worse'.
We made no promises whatsoever to be the same as 7th lists. In fact, my
dissatisfaction with 7th lists (and those of WRG generally) has a great deal to
do with me signing up for this project in the first place.
There is no 'one before'. We have only ever published one Patrician list.
