This came up in a game last week. Two 12 man units of Spanish Scutarii charge each other and both roll up and exhaust. On the second bound, neither unit did 1 CPF. However, one unit did do 3 times as many casualties in hand-to-hand as its enemy unit. Can this exhausted unit break through its opponent thereby causing a waver for second cause of disorder? I searched the rules and the only thing I could find to prevent it was 5.142 Shaken bodies cannot move nearer to known enemy. I'm not sure that applies as you can't get any closer than 0. I was referee and ruled it permissable but it still bothers me, so I thought I'd ask.

That is disallowed by the shaken can't get closer to enemy rule.
-1 is less than 0.
